A Jamaican man who Canadian authorities are contending infected five women in that country with HIV is fighting his extradition.

He is wanted by the Canadian authorities to face charges of aggravated sexual assault.

It is being contended that while he was living in Canada in the late 1990’s he had sexual intercourse with the women knowing that he was HIV positive.

Last month, he was ordered extradited after a hearing in the Corporate Area Resident Magistrate’s Court.

He has taken the matter to the Supreme Court seeking a writ of habeas corpus for his immediate release.

The matter came before Justice Glen Brown this morning but was put off to next Tuesday to give his lawyer, Donovan Foote, sufficient time to join the Commissioner of Corrections as a defendant in the matter.

The applicant is asking the court to release him on the grounds that the offence for which he is being extradited does not exist in Jamaican laws.
