In its application for the injunction, TVJ said they were the exclusive rights holder to free-to-air, satellite, cable, internet transmission, and public viewing of the IAAF World Championships in Jamaica, since July 8, 2013.
TVJ is expected to appeal the decision in the Court of Appeal later this afternoon.
TVJ claimed that CVM breached its rights on two occasions last Saturday, by airing the 400 men’s hurdles heat with Keron Clement and Leford Green and the men’s 100 metre heat one with Asafa Powell.
The application said TVJ sent an email and a subsequent letter, on that day, advising cable operators and free-to-air television stations that it is the exclusive rights holder for the 2015 IAAF World Championships.
TVJ is claiming that the action by CVM caused it to suffer loss and damage. It says CVM was able to carry the event because the satellite footprint is above or near Jamaica, and CVM has the necessary decoder or device to download it.
TVJ says it is also likely that CVM is still in possession of its copyrighted material, and therefore it wants the company barred from continuing the infringement, and from holding its copyrighted material.
